General Conditions of Sale
1. Object and Scope of Application
These General Conditions of Sale regulate the contractual relationship between AVICOLA E INCUBAZIONE PROFESSIONALE DI PADOVAN ALBERTO, hereinafter “Seller”, and the Customer, a natural or legal person who purchases the products on the website www.padovanavicoltura.it
2. Conclusion of the Contract
The contract is considered concluded upon the Seller's email confirmation of the order. Since the products come directly from the manufacturers' warehouses, in the event of temporary unavailability, the Customer will be promptly informed and can choose whether to wait for a restocking, opt for an alternative product, or cancel the order, obtaining a full refund of the amount paid.
3. Prices and Payments
Product prices are indicated in euros and include VAT.
Shipping costs are the responsibility of the Customer and are indicated at the time of ordering.
The customer will have several payment methods available, which can be selected directly at the time of ordering.
The security of your payments is guaranteed by highly reliable external payment systems. We do not collect or store your sensitive data (card number, expiration date, CVV). You will be redirected to your payment provider's secure site to enter your details securely.
4. Right of Withdrawal
Pursuant to Legislative Decree 21/2014, the Customer has the right to withdraw from the contract within 14 working days of receiving the goods. To exercise the right of withdrawal, the Customer must send a written communication to info@padovanavicoltura.it indicating the order number and the products they wish to return. The product must be returned intact, in its original packaging and complete with all accessories, within 14 days of the withdrawal notification. Return shipping costs are the Customer's responsibility. The Seller will refund the amount paid within 14 days of receiving the returned goods.
5. Delivery
The products will be delivered to the address indicated by the Customer when ordering, via express courier.
Estimated delivery times are 2-5 business days. Delays may occur if the recipient is absent, in remote areas, or due to force majeure.
6. Warranty
All purchased products benefit from the legal guarantee of conformity: 24 months for end consumers, 12 months for businesses.
In the event of a lack of conformity, the Customer has the right to repair or replacement of the product, free of charge.
To exercise the warranty, the Customer must contact the Seller at the email address info@padovanavicoltura.it, attaching a copy of the delivery note and a detailed description of the defect.
7. Responsibility
The Seller is not responsible for delays or failures to deliver due to force majeure or unforeseeable circumstances.
The manufacturers and the retailer do not recognize reimbursements for indirect damages, such as the loss of material (e.g. eggs) due to a product defect, nor for further damage to property, people or animals.
The Manufacturer and the retailer will not be held responsible for:
- Failure to follow instructions
- Improper use or incorrect installation
- Inadequacy of electrical or other systems
- Unfavorable environmental or climatic conditions
- Entrusting the product to unsuitable persons
8. Applicable law and competent court
The contract is governed by Italian law. Any disputes will be subject to the jurisdiction of the Court of Padua.
10. Modification of the General Conditions of Sale
The Seller reserves the right to modify these General Conditions of Sale at any time. The new conditions will be effective upon their publication on the website.
Warranty and Refund Policy
Warranty
Product warranties are provided by their respective manufacturers, such as Fiem River and Borotto (this list is not exhaustive), according to the conditions specified by each.
During the warranty period, the manufacturers undertake to repair free of charge any manufacturing defects that arise during normal use of the product.
To request warranty service, you must present the delivery note. The incubator must be shipped in its original packaging at the customer's expense. If the incubator has been used properly and is within the warranty period, repairs will be performed free of charge. However, if no defect is found, the Manufacturer reserves the right to charge the customer for the costs incurred in requesting repairs.
Warranty Exclusions
The warranty does not cover damage caused by:
- Transport
- Wear, water, dirt
- Use not in accordance with what is specified by the Manufacturer
- Repairs or modifications carried out by unauthorized personnel
- Force majeure events (earthquakes, floods, fires, etc.)
Correct Use of the Incubator
The incubator must be used exclusively for its intended purpose. Any other use is considered dangerous and releases the Manufacturer from any liability for damage to people, animals, or property resulting from improper use.
Limitations of Liability
The Manufacturer and the retailer will not be held responsible for:
- Failure to follow instructions
- Improper use or incorrect installation
- Inadequacy of electrical or other systems
- Unfavorable environmental or climatic conditions
- Entrusting the product to unsuitable persons
